Official Reply of the Trademark Office of the State Administration for Industry & Commerce on Recognizing the “JCET” Trademark as the “China Famous Trademark”

Jiangsu Provincial Administration for Industry & Commerce:

The Application of Jiangsu Provincial Administration for Industry & Commerce for JCET Group Applying for the Identification of “JCET” Trademark as the “China Famous Trademark” (SGSCS [2016] No. 24) and other related materials have been received.

According to relevant provisions of the Trademark Law of the People’s Republic of China, the Regulation on the Implementation of the Trademark Law of the People’s Republic of China and the Provisions on the Determination and Protection of Well-Known Trademarks, and through the investigation and study, we hereby determine the JCET Group’s “JCET” trademark (No. 6307679), which is used for IC, (electronic) transistor, semiconductor device (Class 9 goods according to the International Classification of Goods and Services for the Purposes of the Registration of Marks), as the “China Famous Trademark”.

The determination of famous trademark in the Official Reply is to implement the special protection for the trademark to be recognizedin the Application. Where the trademark is in conformity with the provisions of Article XVI of the Provisions on the Determination and Protection of Well-Known Trademarks, the case filing department may implement the protection for the famous trademark in other trademark infringement cases based on the protected record and related evidences. Please guide the case filing department to address related cases according to the provisions of Article XIII of the Trademark Law of the People’s Republic of China and the specified situation, and inform the applicant not to violate the provisions of Clause V, Article XIV of the Trademark Law of the People’s Republic of China.
